Keynote Speaker: Eric Giguere “Buried Alive”

Take advantage of the opportunity to listen as Eric Giguere, a 43 year old former construction worker from Phelps, NY, shares his story of how he was buried alive while working in a trench. Eric explains the circumstances and events that led up to his accident and the profound effects it has had on him and his family for the last fifteen years. Eric speaks from the heart with a desire for the listeners to learn from his death defying safety message. He has a very genuine approach and the intent of his presentation is to prevent this experience from ever happening to anyone again. Eric explains how he is an average guy and a series of extraordinary events left him with an unbelievable story to tell. Once you have heard Eric’s story, damage prevention will be more important to you than ever before!

Life for Eric Giguere only looked up. A capable worker with a good job and good pay, he married on September 28, 2002. Within a week, the newlyweds would be on their honeymoon. Six days after the wedding Eric went to work and looked forward to leaving for his honeymoon after his shift was over. That joy never came to be.

Eric had 5 years experience as a union laborer, and was two months into his first trenching project. The crew was installing a 12-inch water main. Eric got down into the 6.5 foot trench to inspect the pipe, and the trench walls collapsed. He was buried under several feet of soil. Eric panicked. He was unable to breath under the crushing weight. His fear began to subside and a feeling of warmth and comfort overcame him. Eric was dying.

He regained consciousness in the hospital where he learned of the quick action of his team to dig him out. The doctors told Eric he suffered permanent brain damage from the lack of oxygen. Despite the odds against any life other than one of permanent disability, Eric never stopped fighting to overcome what he was told was now impossible.

Eric is an average guy who had the typical attitude toward safety: “Accidents happen, but not to me”. Until the one that nearly took his life. Now Eric’s mission in life is to make sure the arrogance he had toward safety doesn’t become yours. His message is simple and serious, “This can happen to you.”

Eric lectures about his experience and his focus on safety – your safety. He has consulted for many companies, such as ExxonMobil, NiSource, PG&E and Questar Gas. He has spoken at many safety seminars including the American Society of Safety Engineers’ Professional Development Conference, the National Safety Council, the Common Ground Alliance Conference and Expo and the VPPPA. Eric has a great relates with the average “working man” and tells audiences about his personal story from the heart.

Scott Ketcham is the Deputy Director for the Directorate of Construction in OSHA’s National Office.  He was assigned to this position in February 2017 after 18 years in the field with OSHA.

Prior to coming to OSHA’s National Office he was the Area Director for OSHA in Alaska and held the position from September 2007 – February 2017. Other assignments included work as an Assistant Area Director (AAD) in the Lubbock (TX) Area Office, supervising a team of 17 interdisciplinary compliance officers.  Mr. Ketcham has also worked in the Boise, New Orleans, Little Rock, El Paso and Austin Area Offices both as a Compliance Officer and manager.

Before joining OSHA, Mr. Ketcham spent five years as a staff Industrial Hygienist with the U.S. Army Medical Activity at Bassett Army Hospital on Ft. Wainwright, Alaska.  He also served 24 years in Army (Active and Reserve) retiring in 2012 as a Medical Service Corps Officer.

Scott holds a Master’s degree in Public Administration from the University of Alaska, a Bachelor’s of Science degree from Texas A&M University, and is a Certified Safety Professional.

Scott Earnest is Deputy Director for the Office of Construction Safety and Health. Prior to joining the Office of Construction Safety and Health, Scott served as Branch Chief for the Engineering and Physical Hazards Branch (EPHB) in the Division of Applied Research and Technology since 2005.

EPHB conducts research in engineering controls, hearing loss prevention, and aerosol science/nanotechnology. Since joining NIOSH in 1991, he has led research in the control of occupational exposures to air contaminants by serving as a project officer, Team Leader and Branch Chief. He has over 70 peer reviewed publications and technical reports.

Prior to joining NIOSH, he was an active duty, commissioned officer in the U.S. Army, Corps of Engineers. He is a member of the Commissioned Officers Association (COA) of the U.S. Public Health Service (USPHS), and has been active in the American Society of Heating, Refrigerating, and Air-conditioning Engineers (ASHRAE). He is an expert in air filtration, industrial ventilation, and indoor air quality. He is a registered Professional Engineer (PE) and Certified Safety Professional (CSP). He received B.S., M.S. and Ph.D. degrees in industrial and mechanical engineering from the Purdue University, University of Cincinnati, and University of Minnesota, respectively. He has received the PHS Engineer of the Year award, the NIOSH Alice Hamilton Award, the Bullard-Sherwood award, the USPHS Outstanding Service Medal, and the USPHS Villforth leadership award for engineering and public health leadership.

Drug Screening Compliance Institute

Bill is an attorney with over 33 years of experience in the workplace drug and alcohol testing industry and the Co-Founder of Drug Screening Compliance Institute (DSCI) focusing on state, federal and subject-specific compliance training, education and consulting.

He is a past Co-Chairman of the Illinois State Chamber of Commerce Drug-Free Workplace Program, a 10-year member of the American College of Occupational and Environmental Medicine (ACOEM) MRO Faculty, a past advisor to the American Society of Addiction Medicine (ASAM) MRO Committee, A 5-year participant in the White House Office of National Drug Control Policy (ONDCP) Regional Student Drug Testing Summits, and a participant in the 1988 White House Conference for a Drug Free America.

Bill has been involved in many workplace drug testing court cases at all levels, including the 1989 United States Supreme Court decision, Railway Labor Executives’ Association v. Skinner. Bill has edited and written numerous articles and publications, including a reference manual for the motor carrier industry entitled, “Drug Testing: Motor Carrier Compliance Manual,” published by J.J. Keller & Associates, “Omnidex,” “Part 40 Merged,” and co-authored with attorney Tommy Eden, “Doing It Right: DRUG FREE SCHOOL TESTING.” Bill co-founded Info-Lab, Inc. and managed Workplace Health Co-Op, a substance abuse program administrator. During his tenure with Info-Lab, Inc., he co-owned and operated Info-Meth, a DHHS-certified laboratory located in Peoria, IL.

Bill regularly shares his industry expertise & thought leadership at several local, regional and national speaking events such as DATIA, SAPAA, SHRM & NAPBS.

Session Description:

Session will review the new ANSI/ISEA 121-2018, American National Standard for Dropped Object Prevention Solutions, why we should be concerned about dropped objects, and how to properly implement a drop prevention program.

Russ Martin is a 3M Fall Protection Applications Engineer who helps safety professionals solve fall protection and dropped objects opportunities found on their job-sites.  He has been helping others address technical problems for thirty years and focusing on fall protection and dropped object protection for the past seven. Most recently, Russ has focused on sharp edge- foot level tie-off fall arrest situations and dropped object protection standards. He has a biochemistry related MS degree from University of Minnesota and a BS from the University of Wisconsin. Russ is 3M’s 2017 Personal Safety Division’s MVP for Technical Service. Session Description:

The construction industry’s mobile and revolving workforce makes it difficult to implement and sustain a compliant safety program.  In addition, our changing attitudes towards classroom-based training and a desire to consume training on-the-go have created the need to evolve towards a new training model which is commensurate with today’s learning styles.

Micro-learning, as a supplement to traditional online and classroom learning, has proven to improve learner engagement as well as retention.  The training model implemented by construction companies has evolved from what was initially envisioned as a continuous learning program to a full-out embracing of a safety culture.  Construction workers spent less than 60 seconds each day reviewing and responding to a safety question, which is followed by feedback in support of that day’s safety topic.  Test questions, delivered via email, are based on every worker’s job role and target their weakest competency – thus raising the proficiency level of the entire team as fast as possible.

Safety officers and training directors have instant access to reports and charts to help them adjust their training and identify any gaps in compliance.  These same reports of documented remedial training can be used in defense of a lawsuit, or in support of an audit.

The Department of Defense (DoD) Subcommittee maintains a working relationship with the U.S. Army Corps of Engineers (USACE), Naval Facilities Engineering Command (NAVFAC) and U.S. Air Force (USAF) as it pertains to Construction Occupational Safety and Health issues. The DoD Subcommittee provides DoD entities with a partnership that can be used as a sounding board and one that represents the AGC DoD Contractor members. Services include, but are not limited to, reviewing safety and health proposed regulations, forms, policies and programs that affect the AGC Membership. The DoD Subcommittee also provides subcommittee members with continuing education related to construction occupational safety and health on DoD construction projects. Interpretations, variances, and accident trends are all considered topics of discussion.

The subcommittee also focuses on safety issues in other underground utility work as well as specialty work such as excavation, tunneling, boring and site preparation.

The goals of the Silica Task Force currently include, but are not limited to, evaluating opportunities for partnerships with OSHA, NIOSH and others in the construction industry to advance the mission of the Silica Task Force; evaluating existing education and training programs and recommend improvements; and communicating the findings of the Silica Task Force to the construction industry and Members of Congress.

Session Description:

EHS professionals often have their fingerprints on critical documents sought by OSHA or EPA after serious events occur. These individuals can also become targets of tort litigation for inadequate training or supervision, and even face criminal sanctions. In addition, the hard-earned professional certifications can be placed at risk when EHS matters are not handled properly from an ethical perspective, or when practitioners get outside their areas of expertise. This session will review the baseline requirements for ethical performance of EHS duties, and outline the key areas where legal issues can arise. The speaker will also offer proactive solutions to help mitigate exposure and to appropriately manage critical issues including document privilege.

Nick’s construction career started as a union laborer while obtaining a B.S. in Safety Science from Indiana University of Pennsylvania. Kenneth D. Simonson has been Chief Economist for the Associated General Contractors of America since 2001. He provides insight into the economy and what it implies for construction and related industries through frequent media interviews, presentations and The Data DIGest, his weekly one-page e-newsletter that goes to 43,000 subscribers.

Ken has 40 years of experience analyzing, advocating and communicating about economic and tax issues. He currently serves on the Census Bureau’s Scientific Advisory Committee and the Bureau of Labor Statistics’ Data Users Advisory Committee. He is a Fellow and past president of the National Association for Business Economics, and he is co-director of the Tax Economists Forum, a professional meeting group he co-founded in 1982.

Ken has a BA in economics from the University of Chicago, and an MA in economics from Northwestern University.

Dorty is the Florida Group Leader in the Risk Control and Claim Advocacy Practice.  With nearly 25 years of experience in the insurance industry, as a Consultant, Dorty provides value-added claims management service and acts as a resource to the placement of brokers for complex, technical coverage and placement issues. Dorty services a variety of Real Estate, Retail, Communications and Construction clients.

Prior to joining Willis Towers Watson, Dorty worked as a Commercial Property & Casualty Liability Unit Manager.  Preceding this role, Dorty was a Senior Case Manager for Fortune 500 companies and government entities where she managed multi-lines complex exposure claims for national accounts and municipalities. Dorty also has international field experience of high-end exposure losses with multi-million dollar exposure. In her experience, Dorty has led special projects for clients including claim audits, reviews and open claim reduction.

Dorty has presented at the Florida Risk Management Society’s Annual Conference on claim management, risk assessment and loss control.

Dorty provides claims oversight and advocacy in all lines. Her claims management responsibility includes monitoring claim status, providing recommendations on claim strategy and settlements, and assisting in resolving claim related issues for clients.

Laurie is a Claim Consultant in the Risk Control and Claim Advocacy Practice with over 25 years of experience in the claim and risk management field.

Prior to joining Willis Towers Watson, Laurie worked as the Claim Manager for MasTec, Inc. a major infrastructure company and the Manager of Risk Management at AT&T formally DIRECTV in the Entertainment and Communication Group.  Additionally, Laurie has worked for Hilton Hotels as a Risk Control Manager for the Southeast Region.  Laurie has experience handling multi lines of coverage to include workers’ compensation, auto, and general liability claims.

During her career she has promoted the delivery of proactive claims management programs which deliver quantifiable results.

Laurie provides claims oversight and advocacy on all lines.  Her claim management responsibilities include monitoring claims status, providing recommendations on claim strategies and settlements, resolving issues that may arise, review and report claims and conduct quarterly claim reviews with the client and carrier.

Laurie has a degree from Lynn University in Education.  She has completed her ARM 54 and 55 designation courses and is currently working to complete the final course.  Laurie has been a panel speaker at the California Workers’ Compensation and Risk Conference in Dana Point, California.

Session Description:

The national consensus standard (ASME) has defined responsibilities of on-site personnel. OSHA did not adopt these but created new roles and has begun to enforce ASME’s responsibilities as well. The responsibilities were defined in order to make the work site a safer place. However, many employees and employers are unaware of the responsibilities or the qualifications required. The presentation would review the different responsibilities, what the roles are on the job-site as well as what training and qualification is necessary to meet the requirements.

Thom is the third generation of a family that brought cranes and lifting equipment to the Pacific Northwest. Under his leadership, Sicklesteel Cranes, Inc. won multiple national and regional safety awards including the 2012 National AGC Construction Safety Excellence Award and multiple Grand Safety Excellence Awards from the AGC of Washington.

Thom served as a panelist for the SBREFA Committee that reviewed the Federal Crane Rule as well as a stakeholder from the Washington State Crane Administrative Code Committee and Select Committee. Thom has spoken at several events including the Washington Governors Safety Conference and ConExpo. He is a voting member on the ASME B30.5 crane committee and is an alternate on the B30 main committee. He serves on the boards of the National Commission for the Certification of Crane Operators, Inc. as well as 8 other companies / associations.

The term “safety culture” is often overused and misunderstood.  Most companies hold safety as one of their values – something that represents who they are at the core.  However, leaders and employees often fail to demonstrate that value by their words and deeds.  Leaders mean well, but many do not understand what is required of them to achieve “zero harm” on a daily basis.  If safety is a value, all employees should be involved in creating and following clearly defined and understood expectations. There must also be an effective management system in place to ensure those expectations are being met by all members of the organization, just like production & quality.  When an organization truly embraces safety as a value, there are dividends paid in the forms of improved quality, profitability, and morale.  This presentation explores case studies where safety is an interwoven component of operational excellence.

Justin Ganschow has 15 years of experience in the Environment, Health and Safety field working in environmental education, public health and private industry. With Caterpillar Safety Services, he has led safety culture and leadership improvement initiatives in Caterpillar manufacturing facilities and as a consultant to the construction, logging, manufacturing, mining, aggregates, waste/recycling and utilities industries.  Justin is passionate about empowering frontline employees, engaging supervisors in positive accountability practices and supporting leaders in their efforts to shape safety culture. Every year he is invited to speak at numerous industry conferences across the country, and he is a frequent contributor to professional journals and trade publications. Justin is a Certified Hazardous Materials Manager (CHMM) and Certified Safety Professional (CSP). Session Description:

This session will provide key insights of the value of integrating safety, quality, and productivity into a unified approach as compelling risk reduction techniques. The session will be facilitated by an insurance company Vice President – Safety and Quality with a general contractor’s safety and quality directors, providing actual project experiences.  The key discussion points will identify the evolution of a contractors’ approach to Safety, Quality, and Productivity from a rigid siloed method to a collaborative integration of all three disciplines.   The session addresses the underlying cultural changes necessary for transformation from competing priorities into an integrated approach for project execution. The presenters will define and demonstrate best practices applied on their journey to SQP integration.

Dave Murphy has 32 years of industry experience, all with Pepper Construction. He is on the Indiana Construction Association / Indiana Department of Labor Partnership Steering Committee, the AGC of Indiana Safety Subcommittee and is a member of the IU Health Contractor Safety Committee. In 2013, Dave received the Indiana Department of Labor Commissioner’s Award of Excellence in Hoosier Occupational Safety and Health, and he has also been recognized as a Who’s Who in Construction by Building Indiana magazine. He is also regarded by our clients and trade partners and has helped them develop their own safety programs and training. Under Dave’s leadership, Pepper received first place in its division for the 2018 AGC’s National Construction Safety Excellence award.

Dave holds a Master of Science in Industrial Management from Northern Illinois University and a Bachelor of Science in Finance from Illinois State University. He is OSHA 30-hour certified, Green Advantage certified and has his American Society for Healthcare Engineering (ASHE) Healthcare Contractor certification.

Ben started his career in project management before transitioning to quality management in 2012, where his passion and commitment to quality extends beyond the planning and execution of the work to the overall functionality and performance of a building throughout its life cycle.

Ben holds a Bachelor of Arts in Engineering from Wheaton College and a Bachelor of Science in Civil Engineering from Illinois Institute of Technology.  He is a Registered Roof Observer (RRO), Registered Exterior Wall Observer (REWO), a Certified Level 1 Thermographer, and Army Corp. of Engineers Construction Quality Management (CQM) certified.  Ben also is a member of RCI, Inc. and is a Major in the Army Reserve.

Michael Overholt, CSP, ARM, CRIS

Mr. Overholt is the Vice President of Safety with American Contractors Insurance Group. ACIG is a group captive owned by privately held construction companies that provides tailored and sustainable safety solutions for their members. Mr. Overholt provides the strategic leadership and direction of ACIG’s safety efforts across the forty contractors in the captive. He leads a team of safety professionals that act as trusted advisors for their members that put in place over $25BB in volume and working in excess of 70MM man-hours annually working across all states.

Michael has over 23 years’ of experience with ACIG, his prior experience includes progressive responsibilities working for a large EPC firm with disciplines in engineering, project management, and safety. Mr. Overholt holds a Bachelor’s of Science Degree in Building Construction and Contracting from Purdue University.

He is active in the ASSP, including the student mentoring program, Georgia Tech GOLD mentoring program, and the Purdue Construction Advisory Council (CAC). He achieved his CSP, OHST and CET certifications by examination. He also holds the ARM and CRIS certifications, and is a US Green Building Council LEED Green Associate.

Mr. Overholt was recently elected to serve on the Board of Directors for the Board of Certified Safety Professionals, and the BCSP Foundation for a three-year term starting January 1, 2018.

He enjoys woodworking and volunteering for Habitat for Humanity, Kids Chance of Texas, and the Collin County food pantry. Most of all, spending time with his family where his wife, daughter and son keep him busy with sports and homework.

Bob is a national trainer to construction contractors, public entities, insurance companies, associations and others.  Bob has been an OSHA authorized instructor for OSHA 10-hour and 30-hour Outreach courses for Construction.  He is a developer and trainer for OSHA Susan B. Harwood grant safety training programs and safety management programs through AGC.
